FINNIGAN'S SPORTS AND TRAINING PARTICIPANT WAIVER AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.
In consideration for being permitted to participate in activities at Finnigan's Sports and Training, including but not limited to batting cage use, golf simulator use, lessons, training activities, and related recreational activities, I acknowledge and agree as follows:
ASSUMPTION OF RISK
I understand that participation in batting cage activities, golf simulator activities, and related sports activities involves inherent risks that may result in property damage, bodily injury, serious injury, permanent disability, or death. These risks include, but are not limited to, being struck by baseballs, softballs, golf balls, bats, golf clubs, simulator equipment, or other participants; slips, trips, and falls; equipment malfunction; and the negligence of other participants.

I further understand that the use of batting cages, pitching machines, and real baseballs or softballs carries an inherent risk of damage to personal property and equipment, including but not limited to bats, gloves, helmets, and other sporting equipment. I voluntarily assume these risks and understand that Finnigan's Sports & Training is not responsible for damage to personal property or equipment resulting from the normal and intended use of the facility or its equipment.

I understand that batting cage nets are intentionally designed with slack to safely absorb the force of batted balls. When a ball strikes the net, the net may move outward unexpectedly as it absorbs the impact. Anyone standing too close to the front or sides of the net may be struck by the moving net and/or the ball. I agree to remain a safe distance from all batting cage nets, follow all posted safety instructions, and understand that failure to do so increases the risk of injury.

I knowingly and voluntarily assume all risks associated with participation.
RELEASE OF LIABILITY
To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue Finnigan's Sports, its owners, officers, employees, agents, contractors, affiliates, successors, and assigns from any and all claims, demands, damages, losses, liabilities, costs, or expenses arising from or related to my participation in activities at the facility.
AGREEMENT TO FOLLOW RULES
I agree to follow all posted rules, safety signage, facility policies, and staff instructions at all times. I understand that failure to do so may result in removal from the facility without refund and may increase my risk of injury.
MEDICAL TREATMENT
I authorize emergency medical treatment if deemed necessary and agree that I am responsible for all medical costs incurred.
PROPERTY DAMAGE
I agree to be responsible for damage caused by my intentional misconduct, reckless conduct, or misuse of facility equipment.
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Texas. Any legal action arising from this Agreement shall be brought exclusively in the courts located in the county where Finnigan's Sports is located.
SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
