The Most Likely Outcome(s) For/Of the Fiduciary Proposal

Way back in January, we asked NAPA-net readers their opinion on the most likely outcome(s) of the Labor Department’s fiduciary reproposal.

In the six months since then, we’ve now not only gotten a chance to see and evaluate the proposal, but comments have been rolling in, and in short order the DoL will convene hearings to gather additional insights on their proposal, and needed/desired enhancements and/or changes.

So, this week – ahead of that next phase, but having had some time to consider the matter, we’d like to know, What do you now think will be the most likely outcome(s) of the fiduciary reproposal?

Retirement advice will cost more.

The proposal will be enacted and the public will suffer.

Advisors who work with retirement plans will all be fiduciaries.

Advisors who work with retirement plans will be barred (explicitly or effectively) from offering distribution advice.

There will be fewer advisors.

Increase in RR relationship model. Advisor will help plan sponsor choose a full-fiduciary plan provider and embrace EE edu/enroll + rollover

Fewer advisor will work with retirement plans.

The prohibited transaction exemptions included will be sufficient to make the new version workable.

I’ve no earthly idea!

Grassroots and/or political opposition will lead to the proposal being withdrawn - again.

Insurance Agents will get a pass and continue to get large commissions on bad products

Fewer small employer plans will be sold, and thus fewer established.

By the time the regulations are in place, there will be a new Administration, and the proposal will be shelved.

Ultimately, the number of advisors will be unaffected.

The new version will have remedied the most substantive issues with the last two versions.

Initially some disruptive effects, but all will settle out in a few years.

Retirement advice will cost more, but be less vulnerable to potential conflicts of interest.
